Uses and Use Restrictions
Corps of Engineers designs and constructs the project.
Each project selected must be engineering feasible, complete within itself, and economically justified.
The nonfederal sponsoring agency must agree to assume full responsibility for all project costs in excess of the Federal cost limit of $4,000,000; equally share with the Federal government the cost of feasibility studies; contribute toward project costs for construction and maintenance in view of recreational benefits, land enhancement benefits or other special local benefits; provide all necessary lands, easements, rights-of-way; hold and save the United States free from damages; and, provide adequate public landing or wharf, piers, access roads, parking areas and other needed public facilities open and available to all on equal terms.
Local cost participation requirements and procedures for determining the local share of project cost are similar to those for navigation projects specifically authorized by Congress under regular authorization procedures.
No project is to be recommended for implementation under the Section 107 authority for which the total constant dollar Federal costs over 50 years exceed the greater of $4,500,000 or 2.25 times the Federal construction cost, both discounted at the current water project discount rate.

An applicant should consult the office or official designated as the single point of contact in his or her State for more information on the process the State requires to be followed in applying for assistance, if the State has selected the program for review.
Application Procedures
A formal letter to the District Engineer from a prospective sponsoring agency indicating clear intent to provide all required local participation. Advertisement and award of construction is subject to availability of funds from the Chief of Engineers.

The Division Engineer approves an individual project upon the basis of a comprehensive investigation and report by the District Engineer.
